Regulations of the online store - paleciaki.info dated May 1, 2019.

I. Definitions

The terms used in the Regulations mean:

1. Client - a natural person, legal person, or organizational unit not being a legal person, to whom specific provisions grant legal capacity, who places an Order within the Store;
2. Civil Code - the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
3. Regulations - these regulations for the provision of electronic services within the paleciaki.info online store;
4. Online store paleciaki.info - an internet service available at www.paleciaki.info, through which the Client can, in particular, place Orders;
5. Goods - products presented in the Online Store;
6. Sales Agreement - a sales agreement for Goods within the meaning of the Civil Code, concluded between Blachdeker sp. z o.o. with its registered office in Mogilany at ul. Myślenicka 43, 32-031 Mogilany, and the Client, using the internet service of the Store;
7. Consumer Rights Act - the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827);
8. Act on the provision of electronic services - the act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended);
9. Order - the Client's declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods, which results in the obligation to pay.

 

II. General provisions

2.1. These Regulations define the rules for using the online store available at the address www.paleciaki.info.
2.2. These Regulations constitute the regulations referred to in Article 8 of the Act on the provision of electronic services.
2.3. The online store paleciaki.info, operating at www.paleciaki.info, is run by the company Blachdeker sp. z o.o. with its registered office in Mogilany (32-031) at ul. Myślenicka 43, which Customers can contact at the following email address: sklep@paleciaki.info.
2.4. These Regulations specify in particular:
a) the terms and conditions for placing Orders electronically within the online store;
b) the rules for concluding Sales Agreements using services provided within the Online Store.
2.5. To use the online store, the Client should independently access a computer station or end device with Internet access.
2.6. Customers may access these Regulations at any time via the link on the main page of the www.paleciaki.info website and download and print them.
2.7. The essential provisions of the Sales Agreement will be recorded, secured, made available, and confirmed to the Customer by email.
2.8. Information about Goods provided on the Store's website, in particular their descriptions, technical and utility parameters, and prices, constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.
2.9. All products available on the Store's website are brand new, free from physical and legal defects, and have been legally placed on the Polish market.

 

III. Rules for using the Online Store

3.1. Blachdeker sp. z o.o. may deprive the Client of the right to use the Online Store or limit their access to part or all of the resources of the Online Store with immediate effect if the Client violates the Regulations, in particular if the Client:
a) provides false, inaccurate, or outdated data that misleads or violates the rights of third parties,
b) through the online store, violates the personal rights of third parties, in particular the personal rights of other customers of the online store,
c) engages in other behaviors that Blachdeker sp. z o.o. deems inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of Blachdeker sp. z o.o.
3.2. A person who has been deprived of the right to use the online store cannot re-register without the prior consent of Blachdeker sp. z o.o.
3.3. To ensure the security of message and data transmission related to services provided within the Website, the online store takes technical and organizational measures appropriate to the degree of risk to the security of the services provided, in particular measures to prevent the unauthorized acquisition and modification of personal data sent over the Internet.
3.4. The Client is obliged in particular to:
a) not provide or transmit content prohibited by law, e.g., content promoting violence, defamatory or violating the personal rights and other rights of third parties,
b) use the online store in a way that does not disrupt its functioning, in particular by using specific software or devices,
c) refrain from actions such as sending or placing unsolicited commercial information (spam) within the online store,
d) use the online store in a manner that is not burdensome for other customers and for Blachdeker sp. z o.o.,
e) use all content placed within the online store only for their own personal use,
f) use the online store in accordance with the provisions of the applicable law of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

 

IV. Procedure for Conclusion of the Sales Agreement

4.1. To conclude a Sales Agreement via the Online Store, it is necessary to enter the website www.paleciaki.info, select the Goods, their parameters, and take further technical steps based on the messages displayed to the Client and the information available on the website.

4.2. The selection of ordered Goods by the Client is made by adding them to the cart.

4.3. When placing an Order - until pressing the "Order with obligation to pay" button - the Client has the option to modify the entered data and the choice of Goods. To do this, follow the messages displayed to the Client and the information available on the website.

4.4. After the Client using the online store has provided all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information about:

a) the subject of the order,

b) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

c) the selected payment method,

d) the selected method of delivery,

4.5. To send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory, and click the "Order with obligation to pay" button.

4.6. Pressing the "Order with obligation to pay" button entails an obligation to pay.

4.7. Sending the Order by the Client constitutes a declaration of intent to conclude a Sales Agreement with Blachdeker sp. z o.o. in accordance with the content of the Regulations.

4.8. After placing the Order, the Client receives an email message containing final confirmation of all essential elements of the Order.

4.9. The Agreement is considered concluded upon receipt by the Client of the email message mentioned above.

4.10. The Sales Agreement is concluded in Polish, with content consistent with the Regulations.

4.11. The agreement concluded between the Client and Blachdeker sp. z o.o. regarding the purchase of a specific product on paleciaki.info is temporary and lasts for the duration of order fulfillment. The place of performance of the service related to the purchase of products on paleciaki.info is the delivery address indicated by the Client.

4.12. Personal data provided by Clients are collected and processed by Blachdeker sp. z o.o. in accordance with applicable law. The Client making a purchase on paleciaki.info agrees to the processing of their email address to send a survey enabling the expression of opinions about the transaction made on paleciaki.info. The email address will be processed by Blachdeker sp. z o.o. to send the survey, and the data obtained as a result of the survey will be used to publish opinions about paleciaki.info on the Internet.

 

V. Delivery

5.1. The delivery of Goods takes place to the address indicated by the Client when placing the Order.

5.2. The delivery of ordered Goods is carried out with the involvement of specialized postal operators in the form of courier delivery.

5.3. The Client bears the delivery costs specified in the price list indicated on paleciaki.info in the "Payment and delivery" tab.

5.4. The delivery time of products is no longer than 10 days from the date of conclusion of the agreement for domestic shipments and 45 days for international shipments. The delivery time consists of:

  • the time to complete the order and dispatch the goods (up to 3 working days),
  • the delivery time by the postal/courier operator, depending on the chosen delivery method. 5.5. Products may come with a manufacturer's, importer's, or seller's warranty valid in Poland. The warranty period for each product is indicated in the warranty card issued for the purchased product.

 

VI. Prices and Payment Methods

6.1. The prices of Goods provided on the website www.paleciaki.info are net prices in Polish zlotys and do not include VAT, which is added at the final stage of completing the purchase. A receipt or VAT invoice is issued for each product sold - depending on the Client's choice. The VAT invoice will be delivered electronically to the email address provided by the Client, unless the Client explicitly requests that the VAT invoice be delivered in a traditional form.

6.2. The Client is obliged to pay the price for the product ordered on paleciaki.info, including delivery costs, no later than within 7 days from the date of conclusion of the agreement. The following payment methods are possible:

a) bank transfer,

b) online payment - payment via online payments Przelewy24.

 

VII. Right to Withdraw from the Agreement

7.1. According to applicable law, within 14 days from receiving the ordered product, the consumer has the right to return it without giving any reason, subject to exceptions where services and products, the purchase of which cannot be withdrawn from according to applicable law, are excluded. The rules for withdrawing from the agreement that the Client can use, as well as cases in which the right to withdraw from the agreement does not apply, are specified in the instruction, which constitutes Attachment no. 1 to the Regulations.

7.2. The withdrawal form from the agreement constitutes Attachment no. 2 to these Regulations.

7.3. The basis for returns is proof of purchase: a fiscal receipt or VAT invoice.

VIII. Complaints regarding Goods

8.1. Blachdeker sp. z o.o., as the seller, is responsible for product defects based on applicable law. In the case of sales that are not consumer sales, the provisions regarding warranty in the Civil Code are excluded.

8.2. Complaints regarding warranty claims can be submitted electronically to the address sklep@paleciaki.info or in writing to the address Wózki Widłowe Blachdeker ul. Myślenicka 43, 32-031 Mogilany, Poland.

8.3. The Client has the right to demand a price reduction or withdrawal from the agreement unless Blachdeker sp. z o.o., promptly and without undue inconvenience to the Client, exchanges the defective product for a defect-free one or removes the defect. This limitation does not apply if the product has already been replaced or repaired by Blachdeker sp. z o.o., or if Blachdeker sp. z o.o. has not exchanged the product for one free from defects or has not removed the defect.

8.4. If the buyer is a consumer, they may demand the replacement of the defective item with a defect-free one instead of the remedy proposed by the seller, or demand the removal of the defect instead of replacing the item, unless bringing the item into compliance with the agreement in the manner chosen by the buyer is impossible or would require excessive costs compared to the method proposed by the seller. When assessing the excessiveness of costs, the value of the defect-free item, the type and significance of the found defect, and the inconveniences to which the buyer would be exposed by another method of satisfaction are taken into account.

8.5. The reduced price should remain in such proportion to the price resulting from the agreement as the value of the item with the defect remains to the value of the item without the defect.

8.6. The Client cannot withdraw from the agreement if the defect is immaterial.

8.7. Blachdeker sp. z o.o., acknowledges the warranty complaint within 14 days from the date of its receipt in the correct form. If Blachdeker sp. z o.o. does not respond to the Client's requests within 14 days, it means that it has considered the requests justified.

8.8. The basis for the complaint is proof of purchase: a fiscal receipt or VAT invoice.

 

IX. Complaints regarding the operation of the online service

9.1. Blachdeker sp. z o.o. takes actions to ensure the fully correct operation of the Store, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Clients within a reasonable time.

9.2. Irregularities related to the functioning of the Store can be reported by the Client in writing to the address paleciaki.info, Blachdeker sp. z o.o., ul. Myślenicka 43, 32-031 Mogilany, Poland, by email to the address sklep@paleciaki.info, or using the contact form.

9.3. In the complaint, the Client should provide their full name, correspondence address, type, and date of occurrence of the irregularity related to the functioning of the Store.

 

ANNEX No. 1 NOTICE OF WITHDRAWAL FROM THE CONTRACT

The Customer has the right to withdraw from a distance contract within 14 days without giving any reason.

Note! According to the law, the right to withdraw from a contract concluded outside the business premises or at a distance does not apply to the consumer in relation to contracts: in which the subject of the performance is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individual needs.

The deadline for withdrawal from the contract expires after 14 days from the date of delivery of the goods (i.e., the day on which you acquire possession of the item or on which a third party other than the carrier and indicated by you acquires possession of the item).

To exercise the right of withdrawal from the contract, you must inform Blachdeker sp. z o.o. of your decision to withdraw from the contract by means of an unequivocal statement - by submitting a relevant written statement or by completing the Return Form attached as Annex No. 2 to these Regulations, within 7 days and sending it to the address:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise.

Please return the item to us without undue delay and in any event not later than 7 days from the day on which you informed us of the withdrawal from this contract. The deadline is met if you send back the item before the period of 7 days has expired, to the address:

The returned Goods should be properly packaged to ensure the absence of damage during transport. You will have to bear the direct cost of returning the goods, i.e., the cost of packaging and returning the item. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal from the contract does not apply to contracts:

  1. for the provision of services if we have fully performed the service with your explicit consent;
  2. in which the price of the goods is dependent on fluctuations in the financial market over which we have no control and which may occur before the expiry of the withdrawal period;
  3. in which the subject of the performance is a non-prefabricated item, manufactured according to your specifications or serving to satisfy your individual needs.
